Heard the learned counsel for the applicant and the learned APP for the respondent-State.

By this bail application, the applicant seeks bail in Crime No.40 of 2023 registered with Shirpur Police Station, Dist. Dhule, for the offences punishable under sections 302, 143, 147, 148 and 120B of the Indian Penal Code.

The applicant is seeking bail on the ground that the applicant is affected of indeterminate leprosy. He placed on record the medical report of the Medical Officer. Considering his disease, the Court is of the view, it would be harmful to keep him in the prison. Hence, he deserves bail. Hence, the order:

(i) Bail Application is allowed.

(ii) Applicant GANESH @ BHATEYA SUBHASH JAGTAP

1578.2024BA.odt be released on bail for aforementioned crime on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions : (a) He should not tamper with the prosecution witnesses.
