Learned Counsel for the applicants does not press the application so far as applicant No.1 Madhav Dhondiba Waghmare is concerned. As such, application stands dismissed as withdrawn as regards applicant No.1 Madhav.

So far as applicant No.2 is concerned, though specific allegations are made in the first information report against her, however, having regard to the provisions of Section 437 of the Cr.P.C. she being a lady aged about 65 years, it will be appropriate, in my

Cri.Appln.No.4961/2015 opinion to grant regular bail to her. Hence, I proceed to pass the following order.

Applicant No.2 - Gangabai w/o Dhondiba Waghmare be released on bail in connection with Crime No.40/2015 registered at Mukhed Police Station, District Nanded for an offence punishable under Section 302 read with sec. 34 of the Indian Penal Code, upon furnishing P.R. Bond of Rs.10,000/- (Rs.Ten thousand) with one surety in the like amount.
