Mr. Awate, the learned counsel for the petitioner submits that, the proposal seeking approval to the appointment of the petitioner is not been decided by the Assistant Commissioner solely on the ground that the management has not submitted roster of schools at Wadodbazar and Paithankheda run by the respondent No. 7. According to the learned counsel, the recognition of the school at Wadodbazar has already been cancelled in the year 2012. According to the learned counsel, fresh proposal has been submitted by the management, however, Assistant Commissioner is not deciding the same. As the recognition has been cancelled, no question arises of common

The learned Assistant Government Pleader submits that, unless the roster is verified, the proposal for approval cannot be considered.

It is submitted that, the roster of the school where the petitioner is working at Paithankheda has been submitted. The Assistant Commissioner shall consider the factum of withdrawal/cancellation of recognition of the school run by the respondent No. 6 at Wadodbazar and considering the roster as is submitted, shall consider the proposal seeking approval to the appointment of the petitioner on its own merits expeditiously and preferably within a period of four (4) months from today. The writ petition is disposed of. No costs.
