We have heard Mr. Thombre, learned Advocate for the petitioner and Mr. Dande, learned Advocate for the respondents.

The contention of the petitioner is that pursuant to the public notice the petitioner had applied for Plot No. P-19/1 situated at Chikalthana M.I.D.C. It is the further contention of the petitioner that his technical bid was accepted. The petitioner paid an amount of Rs.5,31,420/- towards 5% E.M.D. The petitioner was the highest bidder. According to the learned

2 wp 10638.2019 Advocate, the respondents are not allotting the plot to the petitioner.

Mr. Dande, learned Advocate for the respondents submits that for the same plot another person namely Santosh Sakharam Chadre had also filled-in the bid. His technical bid was rejected. Thereafter, he filed writ petition before this Court bearing Writ Petition No. 9190 of 2019. The same was disposed of on 08.08.2019 on the basis of the statement made by learned Advocate for the petitioner therein. The learned Advocate for the petitioner made a statement that he has received telephonic instructions that the respondents will be going for the fresh tender process. It is because of the same, the respondents have not proceeded further.

According to Mr. Dande, learned Advocate for the respondents, there is no other impediment in the present proceedings.

In case the petitioner is the highest tenderer and if he wants to proceed further with the tender, the respondents can proceed further with regard to the process for allotment of the plot upon intimation to the petitioner in Writ Petition No. 9190 of 2019 that is disposed on 08.08.2019. The said process be completed expeditiously.

Writ Petition is accordingly disposed of. No costs.
