2] Perused the affidavit in reply filed on behalf of the State. We quote paragraph nos.3 and 4 of the said affidavit as under:

"3.

I say that the Police Inspector Laxman Bhausaheb Kale, hash lodged complaint against the petitinoer Raosaheb Vishwnath Tagad, age 30 years resident of Bhistbaug, Tapowan Road, Ahmednagar

Cr.Appln. 4931/13 in Cr.Appeal 179/08 - 2 - presently residing at Harsool Prison, Aurangabad and others on 29.12.2014 bearing CR.No.403/2014, U/Section 420, 465, 467, 468, 470, 471 r.w.34 of IPC and started investigation. A copy of said FIR is annexed herewith and marked as EXHIBIT R-1. 4.

I say that, as the accused / petitioner in the above crime is in jail at Central Jail, Aurangabad, request for getting the custody of the accused for investigation has been submitted to the Superintendent, Central Jail, Aurangabad, vide outward No.147/2015 dated 8.1.2015. A copy of request letter is annexed herewith and marked as EXHIBIT R-2."
