PER COURT :- When the present petition is taken up for hearing, the learned Counsel appearing for the parties jointly tendered across the bar a certified copy of the consent terms on the basis of which Regular Civil Suit No.254 of 2005 has been settled between the parties. The same is taken on record. It is pointed out that according to consent term No.5, the present petitioner, who is plaintiff in the aforesaid Civil Suit has to be paid an amount of Rs.2,50,000/- before this Court. Petitioner is present before this Court. He has affirmed that he has received the amount of Rs.2,50,000/- in addition to the amount of Rs.2,50,000/- already received to him.

In view of the facts as aforesaid, the learned Counsel for the petitioner sought leave to withdraw the petition. Leave granted. Writ Petition stands disposed of since withdrawn. ( P.R. BORA, J. ) SPT
