ORDER :- Learned counsel for the petitioner submits that petitioner has filed appeal No. 175 of 2010, against the order passed by the District Collector, State Excise, Dhule. The same is not decided from nine years.

2. Issue notice to the respondents. Learned AGP accepts service of notice for respondents No.1 and 2.

3. In case, the appeal filed by the petitioner bearing No. 175 of 2010 (Page 25) is pending before State Excise Department Old Custom House, Mumbai, respondent No.2 authority shall take decision upon it on its own merit and in accordance with law expeditiously preferably within a period of six months. The petitioner shall appear before the appellate authority on 03-09-2019. Writ Petition stands disposed. No costs.
