Looking at the subject matter of the petition and respective claims being made by the parties, it appears, lot of questions of facts arise, which are difficult to dealt with, in the writ petition.

In the circumstances learned counsel, on instructions, resiles to that a resort to alternate remedy can be had and, as such, seeks leave to withdraw the writ petition with liberty to prosecute alternate remedy.
