Mr.Gaware, learned counsel submits that petitioner has filed an appeal before Debt Recovery Appellate Tribunal (DRAT), Mumbai against part of the operative order passed by DRT, Aurangabad in Appeal No.5/2014. However, the said appeal was not being heard.

Mr.Deshpande, learned Assistant Solicitor General, submits that the Presiding Officer of the DRAT, Mumbai, was not appointed for some time and now the Presiding Officer of DRAT, Mumbai, has been appointed and is conducting the matters.

In view of that, it would not be appropriate for this Court to entertain the Writ Petition. The petitioner may approach the DRAT, Mumbai and proceed with the mater. We hope and trust that the DRAT,Mumbai, would take up the matter expeditiously. 5.

The Writ Petition is disposed of. No costs.
