In the light of the above, the petitioner shall file an appeal before the Transport Commissioner as would be tenable. If such an appeal is filed by the petitioner, the Appellate Authority shall consider the time spent in prosecuting the appeal before the wrong forum i.e. Honourable Minister and shall decide the appeal on its own merits expeditiously.
