Present Writ Petition has been filed initially for direction to Respondent Nos.1 and 2 to provide the opinion pursuant to the communication dated 9th March, 2024 sent by Respondent No.3. However, by way of amendment now the Petitioner is praying that Respondent Nos.3 and 4 should decide the representations dated 7th May, 2025 and 23rd July, 2025.

Respondent No.3- the Collector is a Member of Selecting Committee for which the Petitioner was selected i.e. Health Supervisor. In fact notification for the said post was issued by

Respondent No.4. According to the Petitioner, he has secured the highest marks in the examination which was conducted pursuant to the advertisement on 4th August, 2023 which was issued by Respondent No.4. Even after the selection list was prepared when Petitioner made inquiry it was informed that by communication dated 9th March, 2024, Respondent No.4 has sought an opinion from Respondent No.1 regarding the appointment of the Petitioner to the said post. According to the Petitioner, when he made the representations now they are not been decided nor Respondent No.1 is giving opinion to the communication dated 9th March, 2024. 3.

Learned AGP waives notice for Respondent Nos.1 to 3 and Mr. Ujwal Patil, learned Advocate waives notice for Respondent Nos.4 and 5.

When the procedure has been prescribed and an advertisement was issued for selection of a particular post then it should have been taken to the logical end. When according to the Petitioner, he has been selected by securing highest marks then that should have been consideration to the representations that has been submitted by him. We, therefore, dispose of the Writ Petition

by directing Respondent Nos.3 and 4 to decide the representations of the Petitioner dated 7th May, 2025 and 23rd July, 2025 by holding a meeting within a period of two months from today. [SMT. VIBHA KANKANWADI] [HITEN S. VENEGAVKAR] JUDGE JUDGE ssp
