Both the parties inform that now the matter is amicably settled between the parties. Compromise terms are reduced into writing and are duly verified. Same are placed on record. 02.

In view of the compromise the petitioner is already taken back in service from July, 2025 pursuant to the order passed by the learned Member, School Tribunal.

It is admitted that the petitioner would pay to respondent No.1 an amount of Rs. 33,23,209/-, out of which, an amount of Rs. 8

( 2 ) wp9897.17 lakhs is already deposited in this Court. Said amount is to be adjusted. The remaining amount is already paid as per the compromise terms. 04.

It is further informed that the petitioner was working against unaided post and thus there would be no liability of pension on the Government.

Considering the above, this Court finds no difficulty in allowing the petitioner to withdraw Writ Petition No. 9897 of 2017. Therefore, Writ Petition No. 9897 of 2017 stands disposed off as withdrawn with no order as to cost. The deposited amount of Rs. 8 lakhs along with accrued interest is allowed to be withdrawn by respondent No.1. Pending Civil Application also stands disposed off. 06.

In view of the compromise, Writ Petition No. 11409 of 2017 also stands disposed off, subject to realization of the cheque amount. [KISHORE C. SANT, J.] snk/2025/Nov25/wp9897.17
