2 926,38,46,54-WP-10409,21,29,37-19 ORDER :- Mr. Godbole, learned counsel for the petitioners submits that the petitioners are appointed as Assistant Teachers in aided school on unaided division.

Respondent No.5 has forwarded proposal to respondent No.3 for seeking approval to the transfer of the petitioners. The proposals seeking approval to the transfer of the petitioners from unaided to aided post are pending with respondent No.3 Education Officer (Exhibit-C) (page-15/16). Learned counsel for the petitioners has relied on the Judgment of Division Bench of this Court in Writ Petition No. 1493 of 2018 and other connected Writ Petitions, dated 4th July, 2019 and submits that the petitioners are entitled to claim approval from the respondent No.3 Education Officer. Such proposals are pending for approval before respondent No.3. 2.

Learned A.G.P. accepts notice for respondents No.1 to 3, whereas, Mr. Vishnu B. Narke, Mr. Shantanu A. Deshpande, Mr. S. N. Lale Yelwatkar and Mr. Joslyn A. Menezes, learned counsels waive service of notice on behalf of respondents No. 4 and 5, respectively. 3.

In case the proposals seeking approval to the transfer of the petitioners from unaided to aided post (Exhibit-C, Page-15/16) are pending with the Education Officer, then the Education Officer shall decide the same on its own merits in accordance with expeditiously preferably within a period of four months from today. The Education Officer shall consider the Judgment referred (supra). Writ petitions are disposed of. No costs.
