Time was granted to the learned counsel appearing for the applicant, by way of last opportunity on 19th October, 2016. Thereafter, the matter was listed on 24th October, 2016 and again the matter was adjourned at the request of the learned counsel appearing for applicant for today.

We have considered the grounds taken in the application for bail in the light of the notes of evidence. There is a homicidal death and it is due to strangulation only. There are specific overt acts against the applicant. The applicant was in jail during the trial.

We do not think it fit case for releasing the applicant on bail. We do not wish to elaborate any further on the evidence as the appeal filed by the applicant is pending for hearing. In that view of the matter, the application stands rejected.

The Registry of this Court shall send the original Record and Proceedings to the Registry of Additional Sessions Judge, Ahmednagar. Upon receiving the original record and proceedings by the Registry of the Additional Sessions Judge, Ahmednagar, the Registry of concerned Court shall prepare the paper book and send it back along with original record and proceedings, as expeditiously as possible, and preferably within three months from receipt of the original record and proceedings.

After receiving the paper book and the original Record and Proceedings,

liberty to mention for early hearing of the appeals.
