The applicants are seeking regular bail in Crime No.I-192 of 2015 registered on 15th August 2015, at Shevgaon Police Station, District Ahmednagar, for offences punishable under Sections 143, 147, 149, 452, 354-A, 364, 307, 342 and 394 of Indian Penal Code. 3.
Learned Counsel for the applicants would urge that the applicants are named as accused in the crime in question, including son of the applicant Subhash and his wife Sangita.

According to learned Counsel for applicants, the custodial interrogation of the applicants is over and the other accused are already released on bail. He would then submit that the probable story as is directed in the first information report has a colour of property dispute. As such, false implications cannot be ruled out. 5.
Learned A.P.P., while opposing the application would urge that the applicants are involved in the offences which are serious in nature. According to him, in view of availability of evidence against the applicants, the application be rejected.

Having considered the rival submissions, it is noticed that the applicants are charged with offences, which are though serious in nature, however, perusal of the medical papers depicts that the complainant/victim suffered simple injuries, which were caused because of hard and blunt object.

Apart from above, the other accused are already released on regular bail by the Court.

The custodial detention of the applicants, in my opinion, will be hardly any assistance to the prosecution, as the applicants are in M.C.R. As such, it will be appropriate to grant protection to the applicants. Hence, I propose to pass the following order.
(I) The applicants Amol Subhash Wani and Subhash Jagannath Wani be released on bail in connection with Crime No.I-192 of 2015 registered on 15th August 2015, at Shevgaon Police Station, District Ahmednagar, for offences punishable under Sections 143, 147, 149, 452, 354-A, 364, 307, 342 and 394 of Indian Penal Code, upon furnishing P.R. Bond of Rs.15,000/- (Rs. Fifteen thousand) and one surety in the like amount, by each of them.
(II) The applicants shall keep themselves away from the jurisdiction of concerned Police Station till filing of charge-sheet. 9.
