Heard learned Advocates for the parties. This application is filed for allowing the applicants-original claimants to withdraw 50% of the amount, which is still lying in the office to this Court. Applicant's earlier application is allowed bearing CA No. 12697 of 2018, wherein 50% of the amount is allowed to be withdrawn with accrued interest.

Learned Advocate Mr. Dheple opposes this application. He submits that if the entire amount is allowed to be withdrawn, it would be difficult to recover the said amount, in case the appeal is allowed. 03.

Considering that the amount of enhancement is meager, this Court is inclined to allow this application.

Hence, this Civil Application is allowed. The applicants are permitted to withdraw remaining 50% of the amount deposited in this Court along with accrued interest on furnishing usual undertaking. [KISHORE C. SANT, J.] snk/2025/Sep25/ca9509.25
