The Petitioner's father passed away on 26.06.2002. The Petitioner has one elder brother, two elder sisters and one younger brother. The elder brother has been given in adoption. The two elder sisters are married. The younger brother Rajesh was granted compassionate appointment by the Respondent company. While undergoing training, Rajesh passed away. The Petitioner applied for compassionate appointment on 13.07.2006 which is after four years of the demise of the father. She is now almost 45 years of age. She submits that she is married and her husband earns by doing a job of a labourer. Details about her marriage and the avocation of her husband, are suppressed from the pleadings in the petition. 1/2

The elder brother Suresh who is said to have given in adoption, is already in the employment of the health department with the State of Maharashtra. When the younger brother Rajesh was offered compassionate employment, the petitioner had no objection as Rajesh was getting an employment with the company. She acquired diploma course in Electrical Engineering in July 2013. She thereafter acquired her B.A. Degree from the Yashwantrao Chavan Maharashtra Open University, Nashik in May 2014. She then passed her MS-CIT in May 2015.

Considering the above aspects and the fact that the father passed away in June 2002 after which the petitioner got married, acquired diploma/degree certificates, as noted above, in between 2013 to 2015, after 21 years of the death of the father and the Petitioner almost being 45 years of age, we do not find any reason to entertain this Petition for granting appointment on compassionate basis.
