23.07.2019 P.C. :- The learned A.G.P. submits that the tribe claim of the petitioner is pending with vigilance.

The learned counsel submits that the petitioner is not accorded approval to the appointment and services as a Gramsevak and the salary is also not disbursed from 17.06.2017.

The respondent-authority shall consider the proposal for approval to the appointment of the petitioner as Gramsevak on its own merits subject to the decision that would be taken by the committee in the validation

( 2 ) 99 wp 12781.18 proceedings of the petitioner. The committee shall decide the validation proceedings within six months. The petitioner shall appear before the scrutiny committee on 01.08.2019.

If the petitioner is discharging his duties then the respondent shall not withhold the salary of the petitioner only on the ground that validation proceedings is pending. The employer may take further course of action depending upon the decision that would be taken by the committee in the validation proceedings. Writ petition is disposed of. No costs. [MANGESH S.
