IN THE HIGH COURT OF JUDICATURE AT BOMBAY

BENCH AT AURANGABAD 64 CIVIL APPLICATION NO.14111 OF 2022 IN FAST/25159/2022 SANTOSH PANDHARINATH PAWAR (DIED) THR LRS SHANTABAI AND OTHERS

VERSUS

THE STATE OF MAHARASHTRA THROUGH THE COLLECTOR, JALNA AND OTHERS ...

Mr. Dinesh Manwatkar, Advocate for the applicants. Mr. A.B. Chate, A.G.P. for respondent Nos.1 and 2. ...

CORAM :

SANDIPKUMAR C. MORE, J.

DATED :

05.12.2022.

ORDER:- 1.

Heard rival submissions. The applicants are seeking condonation of delay of 2200 days in filing the appeal. The delay appears to be caused due to their financial crisis. The learned A.G.P. strongly opposed the applications on the ground that the delay is not properly explained. The Acquiring Body, though served, but remained absent.

2.

However, considering the statutory right of the applicants, the application is allowed and the delay of 2200 days stands condoned subject to condition that the applicants shall not claim any interest for the aforesaid delay period.

(2) 64 CA-14111.2022.odt 3.

The appeal be placed for admission after removal of office objections.

4.

The Civil Application is disposed of accordingly. (SANDIPKUMAR C. MORE, J.) vd_dhirde
