The petitioner is aggrieved by the order dated 02.05.2019 passed by the Deputy Charity Commissioner, Nanded.

By the order impugned all that is done is that a prima facie or tentative opinion is expressed that since the Managing Committee is de-facto or an ad hoc body, it would be appropriate to hold elections. The Authority has not taken a fnal decision and has directed issuance of notice to the trustees to submit their response to the tentative or prima facie opinion expressed. Learned Counsel for the petitioner submits that the said expression of opinion ignores the fact that while the Change Report for the year 2012 to 2017 is

(2) WP-2084 of 2020.odt rejected, the petitioner has submitted the Change Report for the year 2018 onwards.

Be that as it may, no fnal decision is taken by the Authority and it shall always be open for the petitioner or any other trustee or any person interested in the Trust, to appear before the Authority and to demonstrate that it would not be necessary to hold fresh elections.

The petition is premature and is dismissed.
