An undertaking is furnished by the applicant that he shall deposit 40% of the compensation amount as ordered by the learned Additional Sessions Judge, Aurangabad on 20th July, 2016 in Criminal Appeal No.119 of 2016, provided he is granted some installments. According to the applicant, of the 40% amount of compensation as ordered, he shall deposit half of the said amount, i.e. 50% of 40% within a period of four weeks from today before the appellate court and balance 50% of 40% within four weeks thereafter.

The undertaking in above respect is accepted.

In view thereof, the order passed by learned Additional Sessions Judge, Aurangabad, on 20th July, 2016, in Criminal Appeal No.119 of 2016, below the application for suspension of the substantive sentence and grant of bail, is modified in above terms.

Respondent no.2 - complainant is not put to notice as the learned Addl. Public Prosecutor is heard in the matter and also it is noted that the order is innocuous.
