Heard learned counsel for the applicants and the respondents.

I have gone through the award. It appears that some error has been committed by the Reference Court while granting interest under Section 28 of the Land Acquisition Act. Therefore, permission is granted to the applicants to withdraw in this appeal with proportionate accrued interest thereon till the date of withdrawal, subject to filing of written undertaking within a period of twelve weeks from the

ca14391.18 date of passing of this order to deposit the withdrawn amount as and when directed by this Court. Out of the remaining amount 25 per cent amount is allowed to be withdrawn by the applicants, subject to filing solvent security qua the withdrawn amount to the satisfaction of the Registrar (Judicial). Remaining 25 per cent amount shall be invested in the fixed deposit in any Nationalized Bank till final disposal of the appeal.

The Registrar (Judicial) to act accordingly.

Civil Application is disposed of.
