In view of the submissions of Mr.Gangakhedkar, learned Advocate that the writ petition would not be tenable and instead an appeal from order needs to be filed, the learned Advocate for the petitioner submits that he would convert this petition into an Appeal from Order.

In view of the above, the civil application is disposed off. Liberty granted to the petitioner to convert this petition into an Appeal from Order. Needless to state, the issue as regards delay, as is raised by Mr.Gangakhedkar, would be considered by the Court assigned with the Appeal from Order.
