ORDER :

1) At the request of the learned counsel for the petitioners leave is granted.

2) Learned counsel for the petitioners, on instructions, seeks leave to withdraw the writ petition to the extent of petitioner no. 3 Rajkumar Pratapsingh Rathod. Leave granted. 3) The learned AGP appears for respondents.

4) It is not disputed that the issue raised in the present writ petition is covered by this court in number of matters, such as Writ Petition No. 3861/2014 under order 25th April, 2014 and it is held that even the non teaching members of the Private Ashram School are entitled for the benefit of Assured Career Progress Scheme. In the light of that, we pass following order : The respondents are directed to examine the cases of each of the individual petitioner for deciding whether they satisfy the criteria laid down for claiming benefits under the ACPS to the private aided Government Schools under the Government

2 WP13630 / 2017 Resolution dated 30th April, 1998, as modified from time to time, and if it is found that the petitioners are entitled to claim benefits under the Scheme, and they satisfy the eligibility criteria, the respondents shall extend the benefits to the petitioners in these petitioners. The respondents shall scrutinize the cases of individual petitioners within a period of six months, and extend the benefits to such of the petitioners who are found eligible, as expeditiously as possible preferably, within the period of four months from such scrutiny.

5) Writ Petition is disposed of. No costs.
