Present application is for condonation of delay, setting aside abatement and bringing heirs of applicant No.6 Mathurabai @ Vimalbai Ramrao Madke on record. The cause of action survives against heirs mentioned in the title of the application. There are no malafides causing any delay in taking steps against deceased applicant.

For the reasons stated in the application, it stands allowed in terms of prayer clauses "B" and "C" on condition of depositing cost of Rs.3,000/- with the High Court Advocates' Bar Association within a period of four (4) weeks from today.
