O R D E R

This appeal is placed before us in today's National Lok Adalat. Learned Advocate Mr. Katneshwarkar, is present on behalf of Appellant Shantabai. The learned Advocate Mr. Katneshwarkar has made her identification. On authority letter, learned Advocate Mr. Deshmukh is present on behalf of Respondent No. 2, Insurance Company and the authorized officer of Insurance Company Ms. Anuja Vikas Joshi is personally present.

The learned Advocates for both the parties submit that they have amicably settled the lis and placed on record the terms of compromise. The compromise terms are marked as Article "X" for the purpose of identification. 3.
Respondent No. 2 Insurance Company has already deposited the amount of compensation as per judgment and award passed by MACT, Basmatnagar, District Parbhani, in MACP No. 5 of 2007 and the Original Claimant has already withdrawn the same.

Now respondent No. 2 Insurance Company agreed to pay an amount of enhanced compensation of Rs. 2,00,000/- (Two Lakhs Only) to the Claimant Shantabai, in addition to amount of compensation awarded by MACT, Basmat, within a period of 8 weeks from today, in terms of compromise before this National Lok Adalat. The aforesaid amount of enhanced compensation is to be withdrawn by the Claimant Shantabai without back reference to this Court and without filing any separate application, in terms of award passed by this National Lok Adalat on its deposit.

The Member, Motor Accidents Claims, Tribunal, Basmat be informed accordingly.

The Court fee refund certificate be issued as per the provisions under the Maharashtra Court Fees Act, 1959. 7.
Award be drawn up accordingly.
8.
The First Appeal and pending Civil Application, if any, stand disposed of.
