After 13 years of acquittal and during the pendency of the State's Criminal Appeal No.450 of 2012, the Petitioner has filed this Petition on 28.08.2024, praying for post retirement benefits.

The learned AGP raises a specific objection in the light of Section 3(q) and Section 15 of the Administrative Tribunals Act and contends that the Maharashtra Administrative Tribunal is available at Aurangabad. The Tribunal has the jurisdiction to deal with this Petition since the Petitioner was in Government service.

In view of the above, this Writ Petition is disposed off from the file of this Court. The Registry is directed to transfer this Petition to the learned Maharashtra Administrative Tribunal, expeditiously.
