This application is for transfer of proceeding of HMP No. 373 of 2023 pending before the Court of learned CJSD, Panvel to the Court of CJSD, Aurangabad. Learned Advocate for the applicant submits that there is twin to the couple, which is presently residing with the wife. The age of the twin is around three years. It is thus difficult for the applicant to attend the proceeding at Panvel. There is also case pending at Aurangabad filed by the applicant under the Protection of Women from Domestic Violence Act, which the respondent has to attend. Considering the same, this Court is inclined to allow the application.

The application is, therefore, allowed in terms of prayer clause (B). The applicant shall not take unnecessary adjournments in the proceeding. The learned Trial Court shall try to dispose of the proceeding as early as possible and preferably within one year from the date of the transfer.
