Upon hearing, learned counsel for the applicant seeks liberty to withdraw the present application with liberty to file appeal before the Sessions Court. He however submits that there may be delay in filing the appeal in the Sessions Court.

In the circumstances, with advice to the learned Sessions Court to consider the delay caused in prosecuting the present appeal in this Court, sympathetically, the applicant is allowed to withdraw
