The learned advocate for the respondents states that since the suit itself is decided, the present petition has become infructuous.

The learned advocate for the petitioner on the other hand states that direction to the petitioner to deposit court fee is questioned in the present petition. The plaint is rejected for not depositing the court fee. The petitioner has already filed appeal challenging rejection of plaint.
