Heard the learned counsel for the applicant and the learned A.P.P. for the respondent/State.

The applicant was the driver of the vehicle in which the dead body was carried. The applicant was with co-accused all the time. A strong evidence is available against the applicant that he brought petrol in two bottles, which was used to burn the deceased. Not only this, after the incident, the applicant fled away with other co-accused at Vardha. The applicant himself went to the owner of the car saying that the co-accused wanted to hire the car. Present applicant and the co-accused were resident of the same village. The foremost adverse conduct of the applicant post incident was that he did not lodge the report though he was aware of serious offence of murder. There is a strong circumstantial evidence against the applicant. The possibility of conspiracy cannot be ruled out. In that view of the matter, it is not desirable to grant the bail. Hence, the application stands dismissed. ( S. G. MEHARE, J. ) rrd
