Heard the learned counsel for the applicant and learned APP for the respondent-State.

The applicant seeks bail in Crime No.121 of 2024, registered with Begampura Police Station, District Aurangabad, for the offences punishable under Sections 307, 143, 147, 148, 149 of the IPC and Section 4/25 of the Arms Act and Sections 37(1)(3), 135 of the Maharashtra Police Adhiniyam Act. 3.

The incident happened on 26.04.2024 at about 9.00 p.m. in the pre-marriage programme. It has been alleged against the applicant that he and other co-accused assaulted the injured with wooden log and knife. The injured has received the abdominal stab injury. However, those were

simple. The injured has been discharged from the hospital. The alleged weapon used in the crime has been recovered. Two attempts of the applicant to secure the anticipatory bail were failed. Hence, he was arrested on 22.07.2024. Nothing is to be recovered from the applicant. He is the first time offender and a young boy of 19 years old. Considering the facts of the case, it would be inappropriate to keep him behind bar. Hence, the following order :

O R D E R

(i) Bail Application is allowed.

(ii) Applicant PIYUSH RAJESH YERPULE be released on bail on furnishing P.B. and S.B. of Rs.50,000/- (Rupees Fifty Thousand only) with one solvent surety of like amount, on the following conditions :

(a) The applicant should not tamper with the prosecution witnesses.

(b) He should not contact the injured in any mode or manner till the trial is concluded.

(c) He should attend the Police Station as and when called on written notice by the

Investigating Officer till filing of the charge sheet.
