We have heard Mr.Paranjape, learned counsel for the petitioner and learned A.G.P. 2.

The petitioner assails the gradation list dated 12.5.2017 and the order dated 3.8.2017, passed by the Tribunal.

As far as challenge to the gradation

2 W.P.No.10460/17 list is concerned, the petitioner has a remedy before the Maharashtra Administrative Tribunal, to challenge the same. In view of that we are not considering the challenge of the petitioner to the gradation list. The petitioner may file proceedings before the Tribunal and in that event all contentions with regard to challenge to the gradation list are kept open.

In its order dated 3.8.2017, the Tribunal has only directed the Respondent No.2 in the Original Application to decide the representation of the Original Applicant within four (4) weeks.

Naturally, the said representation has to be decided by the authority on its own merits, considering all the aspects of the matter.

As no adverse orders are passed in the Original Application, the present Writ Petition can not be entertained.

With these observations, the Writ
