Order :- 1.

Application tendered by the petitioner to start new Ayurvedic College have been turned down by the Government of India Ministry of Ayurveda, Yoga and Naturopathy, Unani, Siddha and Homeopathy (for short "AYUSH") on 21-05-2016 for the reason that application was received beyond stipulated period. It is recorded in the order that in view of section 13A of the Indian Medicine Central Council Act, 1970, application shall have to be presented between 1st April to 30th April of relevant year. Since application was tendered belatedly, Ministry of AYUSH was justified in not considering the same. 2.

Apart from this, it would be for the petitioner to tender application for starting the Ayurvedic College during next academic

2 WP 9455-16 year within time frame prescribed under the regulations, and if such application is made, it would for the respondent - authority concerned to consider the same in accordance with law.
