DATE : OCTOBER 06, 2022 ORDER :- This is an application under Section 439 of the Code of Criminal Procedure. The applicant has been arrested in connection with Crime No.6293 of 2020 registered with Topkhana Police Station, Ahmednagar.

Heard learned counsel appearing for the parties. 3.

The applicant is a woman. She was Chairman of Cooperative Credit Society. As per the forensic audit, the applicant is not alleged to have misappropriated any amount. What is found is that the Society has disbursed heavy loans amounting to Rs.59 Crores. The applicant is in jail for little over ten months. On investigation, charge sheet has been filed. It is informed that an

3-BA.1580.2022 Administrator has now been appointed and the process of recovery of the amount from the defaulters, is being undertaken. If this is so, the Court is inclined to grant the applicant bail. 5.

In view of the above, the Court is inclined to grant the applicant bail. Hence, the following order:- (i) The application is allowed.

(ii) The applicant be released in connection with Crime No.6293 of 2020 registered with Topkhana Police Station, Ahmednagar, on executing P.R. Bond in the sum of Rs.1,00,000/- (Rupees One Lakh) with one surety in the like amount. (iii) The applicant shall not tamper with the prosecution evidence.

(iv) The applicant shall surrender her Passport to the concerned police station.
