Heard learned counsel for the applicant. The respondent despite service, remained absent.

The applicant is seeking transfer of Marriage Petition No.A-99 of 2022 fled by respondent husband for restitution of conjugal right from Family Court Jalna to Family Court, Beed. 3.

According to the applicant, she is not having any independent source of income and she has to maintain two years child. Moreover, the applicant has also fled criminal prosecution under Section 498A of IPC against the respondent at Beed, wherein the respondent has already appeared. Moreover, she has also lodged a criminal prosecution under Section 498A of IPC against the respondent at Beed only. Thus, it appears that since the respondent is already attending the dates at Beed, the proceeding fled by him in Family Court, Jalna can be conveniently transferred as prayed by the applicant. Hence, following order.

ORDER

(i) The application is hereby allowed.

(ii) The Marriage Petition No.A-99 of 2022 pending in Family Court, Jalna is transferred to the Family Court, Beed for its disposal according to law.

(iii) The respondent is directed to appear before the Family Court, Beed on or before 25/01/2023.
