ORDER:

The present writ petition is filed against the order of the Maharashtra Administrative Tribunal allowing original application filed by respondent No.4, challenging the transfer effectuated. The tribunal allowed the original application filed by respondent No.4 cancelling the order of transfer.

After the matter was heard for some time, it was brought to the notice that present respondent No.4 has filed application to the State Government with regard to the posting at different places. 3.

Mr. Kale, the learned Government Pleader submits that the State has considered the request of respondent no.4 and now has posted him as Assistant District Supply Officer, Ahmednagar. The said posting, it appears, is accepted by respondent No.4.

In view of above, the grievance of respondent no.4/original applicant, to some extent, stand redressed.

In light of that, the order of the tribunal is quashed and set aside and it is modified to the extent that present respondent No.4 is transferred and posted as Assistant District Supply Officer, Ahmednagar and the present petitioner is retained at Dhule.
