Present writ petition is filed on the premise that signature of the petitioner No. 1 while filing earlier writ petition was taken by misrepresentation.

On the last date, Mr. Kalani, the learned advocate for petitioners on instructions of the petitioner No. 1 made a statement that, the petitioner No. 1 does not want to prosecute the writ petition. We expressed our displeasure as to the manner of prosecuting the petition by the petitioner No. 1. 3.
Today, Mr. Kalani, the learned advocate for petitioners has
2 wp 8237.18 filed an affidavit of the petitioner No. 1. It is submitted that, he is also present in the Court. He has tendered unconditional apology for filing present petition.

Considering the above, we accept unconditional apology and dismiss the petition to the extent of the petitioner No. 1. 5.
We have also heard Mr. Kalani, the learned counsel for petitioners with regard to the prayers made on behalf of the petitioner No. 2. We find that, the petitioner No. 2 is daughterin-law of the deceased. The daughter of the deceased has already filed an application for appointment on compassionate ground. It is a fact that, the petitioner No. 2 is daughter-in-law of the deceased. The grievance of the petitioner No. 2 is not justified. 6.
In the light of the above, the writ petition is dismissed. No costs.
