We have heard learned advocate for the petitionerapplicant and the learned AGP. None present for respondent Nos. 4 and 5, though duly served.

By way of this Civil Application, restoration of the writ petition, which has been dismissed in default, has been sought with a prayer to condone the delay of 168 days.

The nature of the dispute and the explanation assigned in the application pragmatically deserve the delay to be condoned and the writ petition is to be restored, however, not without the usual conditions.

The application is allowed. The delay is condoned and the writ petition is restored subject to the petitioner depositing cost of Rs. 3,000/- in this Court and removes office objections, both within two weeks.
