PER COURT :

Heard. The applicant was granted bail on merits. Since he remained absent before the trial Court, the Court concerned issued non-bailable warrant against him. The same came to be executed. As such, the applicant is behind the bars. The trial Court then refused to grant him bail. 2.

According to learned counsel for the applicant, it was during pandemic Covid-19 he was not keeping well and, therefore, could not appear before the trial Court. The applicant now undertakes that he would co-operate with the

trial in the matter. In view of the same, the Court is inclined to allow the Bail Application without issuing notice to the respondent No.2 - informant, in the facts and circumstances of the case. Hence the order :

O R D E R

(i) The Bail Application is allowed.

(ii) The applicant be released in connection with Crime No.66/2015, registered with Mukundwadi Police Station, Aurangabad for the offence punishable under Sections 376(2) (K), 323, 324, 504, 506 read with Section 34 of the Indian Penal Codeand Sections 4, 5(N) and 6 of the Protection of Children from Sexual Offences Act, on his executing P.R. bond in the sum of Rs.15,000/- (Rupees fifteen thousand) with one surety in the like amount.

(iii) The applicant shall not tamper with the prosecution evidence.
