Applicant apprehends arrest in Crime No.336 of 2021 registered with Shirpur City Police Station, District- Dhule for offence punishable under Sections 392, 395 and 397 of the Indian Penal Code.

FIR is lodged by Jaipal Ashoksing Girase contending that on 23rd August, 2021, after he collected cash from his Company and went to deposit it in the bank, at that time, three persons robbed him and took away the cash.

Heard learned advocate for applicant and learned APP for the State. Perused the papers of investigation.

Though name of applicant is not mentioned in the FIR, coaccused have stated participation of applicant in the alleged offence. Applicant is identified by informant in Test Identification Parade. Cash of Rs.4,64,600/- is recovered from the arrested accused persons. Total amount of Rs.13,47,761/- was robbed by applicant and co-accused persons, which is distributed amongst accused persons equally. Investigation papers show that though charge sheet is filed, since applicant is absconding, investigation to the extent of applicant is yet to be completed and stolen cash and documents are yet to be recovered from him. 5.
Taking into consideration gravity of accusations and recovery of the amount, to be made from applicant, his custody is necessary for effective investigation. Applicant, therefore, does not deserve discretionary relief of anticipatory bail. Application is, therefore, rejected.
