DATED : 14th DECEMBER, 2018 Order :- Learned counsel appearing for the parties jointly submit that the issue raised in these petitions has been considered by the Division Bench of this Court (Coram : S. V. Gangapurwala and Sunil K. Kotwal, JJ.) under Order dated 5th July, 2018, in Writ Petition No. 5237 of 2017

2 996 WP-11214-18 [Pandharinath Vishwanath Khade Versus The State of Maharashtra and others] and connected matters. They further submit that the petitions be decided in terms of directions contained in the said order. 2.

Considering the above, we pass following order :- (i) Respondent No.3 shall examine the claim of the petitioners in the light of observations made by Division Bench of this Court in the case of Uddhav Trimbak Umbare Versus State of Maharashtra and Others in Writ Petition No. 9398 of 2012, decided at Bombay, dated 01-02-2013 and pass speaking order in regard to the claim of the petitioners for treating them as full time Assistant Teachers, Shikshan Sevaks.

(ii) The decision shall be taken by respondent no.3, expeditiously and in case the petitioners are found eligible, the proposals of the petitioners will be forwarded to respondent No.2.

(iii) The status-quo as it exists today in respect of the employment of the petitioners shall be maintained by respondent No.3 till the decision as aforesaid is taken.

(iv) The Writ Petitions are disposed of. No costs. [ K. K. SONAWANE, J. ] [ S. S. SHINDE, J. ] MTK
