The petitioner is challenging the order of suspension issued by the Education Officer (Primary), thereby suspending the petitioner. 2.

As per Rule 12 of the Maharashtra Zilla Parishad District Services (Discipline and Appeal) Rules (1964), if the order of suspension is made or deemed to have been made by an authority other than the Chief Executive Officer, may appeal against such order to the Executive Officer.

In the light of that, the petitioner has a remedy of appeal. The petitioner is at liberty to file the same. All contentions are kept open. 4.

The writ petition is disposed of. No costs.
