The delay caused in each appeal preferred by agriculturists/claimants have been quoted above. There are lapses on the part of applicants in securing first order after filing of the matters in High Court. Last two columns of above table would indicate the lapses. Learned counsel for the applicants submits that for the reasons stated in the applications, it is desirable to condone the delay. Applicants are ready to forego the interest and statutory benefits. 4.
Learned AGP opposes the applications. It is contended that inordinate delay has not been properly explained. It is submitted that after filing of the matters, no prompt steps have been taken by the applicants by circulating the matters which has caused further delays. 5.
I have gone through the contents of the application for condonation of delay. Those are uncontroverted and can not be discarded. For the reasons stated therein, I am inclined to condone delay on certain conditions :
5 961-966(i).CA-6149-2024.doc a) Applicants shall not be entitled to interest and the statutory benefits for the delayed period as well as for 50% period of the lapses which is from the date of filing of the appeals and date of order as enumerated in last two columns of the table quoted above. 6.
Civil applications are allowed thereby condoning the delay as specifically stated in the table referred above on condition that applicants shall not be entitled to interest and the statutory benefits as well as 50% period of the lapses i.e from date of filing of the appeals to the date of first order.
