Applicant apprehends arrest in Crime No. 188 of 2023, registered with Nizampur Police Station, Taluka Sakri, District Dhule for offences punishable under sections 326, 327, 143, 147, 148, 149, 504, 506 of the Indian Penal Code. 2.

FIR is lodged by informant Narayan Tulshiram Thorat alleging that on 17.07.2023 at about 07.00 p.m. while he was working in the agricultural field, at that time, six accused persons including applicant assaulted him with sticks. Accused Suresh and applicant assaulted him on head and legs. He lost gold ring and Rs.2,000/- in the said assault. Pursuant to registration of offence, five accused persons were arrested and

908-ABA-1405-23 weapons allegedly used in the offence are recovered from them. Charge-sheet is filed in the present crime on 02.11.2023.

Cross complaint is lodged about the same incident by Suresh Koradkar i.e. accused No.4 in present crime, which is registered at Crime No.190 of 2023 with Nizampur Police Station, Taluka Sakri, District Dhule for offences punishable under section 324, 323, 143, 147, 148, 149, 424, 504, 506 of the Indian Penal Code against 14 accused persons including informant in the present crime.

Since charge-sheet is filed, custodial detention of applicant is not warranted in the facts of the present case. 5.

Application is therefore allowed in terms of interim protection granted on 24.08.2023.
