Heard the learned counsel for the applicant, learned APP for the respondent-State and learned counsel for the complainant assisting the learned APP.

The serious allegations were levelled against the applicant that he duped the complainant under the garb of providing him a job for Rs.14,00,000/-.

However, today the complainant filed an affidavit contending that he has no grievance against the applicant. The applicant never duped him. The applicant has no nexus with the alleged offence. He never gave him false assurance to

provide him a job in S.R.P.F. He has no objection to grant anticipatory bail.

The complainant is present in the Court. He has admitted the contents of the consent affidavit. It is supported with his Aadhar Card. Consent Affidavit taken on record and marked at 'Exh-A'. The offence punishable under Section 420 is compoundable.

The learned counsel for the complainant has filed an application under Section 301 of the Cr.P.C. to assist the learned APP.

Considering the consent affidavit of the complainant, there is no hesitation to grant anticipatory bail to the applicant. Hence, the following order :

O R D E R

(i) The application is allowed.

(ii) In the event of arrest, applicant BALAJI SUDHAKAR WAGHMARE, be released on bail on furnishing P.B. and S.B. of Rs.20,000/- (Rupees Twenty Thousand only) with one solvent surety in the like amount in Crime No.300 of 2018, registered with Police Station Vasmat City, District

Hingoli, for the offences punishable under Sections 420, 465, 467, 468, 471, 120-B of the IPC, on the conditions that he shall attend the Police Station as and when called by the Investigating Officer. He shall not tamper with the prosecution witnesses.

(iii) Criminal Application No.3193 of 2022 to assist learned APP is allowed.
