By this application, the applicant seeks to relax the condition no.ii(b) under the order dated 13.12.2023 passed in B.A. No.2133 of 2023 by which he was prevented from entering in village Shelgaon, Tq.Kalam, District Osmanabad till conclusion of the trial while granting bail.

Learned advocate appearing for the applicant submits that applicant has abided all the conditions as imposed under order dated 13.12.2023 however, applicant is depending on income from agricultural land. His family is totally dependent on agriculture. Because of the conditions imposed while granting bail, his agriculture land could not be cultivated. Other family members are not residing in village

cran 3772.24.odt Shelgaon. Therefore, there is no one to take care of the land. It appears that till this date, trial is not commenced although charge is framed in the pending sessions case. There is no complaint that applicant has breached any condition of the bail. In that view of the matter, request can be partially considered.

The condition no. ii(b) imposed vide order dated 13.12.2023 is therefore modified to the extent that applicant is permitted to enter his agricultural land only for the purpose of cultivation. However, he shall not stay or continue to remain in village Shelgaon for any other purpose. His entry in the village Shelgaon would be restricted only for the purpose of accessing his agriculture land. The applications stands disposed off in aforesaid terms.
