BENCH AT AURANGABAD 955 CIVIL APPLICATION NO.5317 OF 2022 IN FAST/27173/2021 THAGANABAI BABURAO BANKAR AND OTHERS
VERSUS
THE STATE OF MAHARASHTRA THROUGH COLLECTOR, JALNA AND OTHERS ...
Mr. S.A. Kale, Advocate holding for Mr. D.M. Pingale, Advocate for the applicants.
Mr. A.B. Chate, A.G.P. for respondent Nos.1 and 2. ...
CORAM :
SANDIPKUMAR C. MORE, J.
DATED :
29.11.2022.
ORDER:- 1.
Heard rival submissions. The applicants are seeking condonation of delay of 1683 days in filing the appeal. The delay appears to be caused due to their financial crisis. Learned A.G.P. strongly opposed the application on the ground that delay is not properly explained. The Acquiring Body though served, but remained absent. However, considering the statutory right of the applicants, the delay of 1683 days stands condoned subject to condition that the applicants shall not claim any interest for the said delay period. 2.
The appeal be placed for admission after removal of office objections, if any.
3.
The Civil Application is disposed of accordingly. (SANDIPKUMAR C. MORE, J.) vd_dhirde
