The present applicant is seeking regular bail in Crime No. 109/2015 registered with Police Station, Renapur, District Latur for an offence punishable under Sections 364-A, 323, 504, 506 read with Section 34 of the Indian Penal Code, on the ground that the present applicant alongwith other accused persons abducted one Shamrao Jadhav, husband of the complainant and demanded ransom of Rs. 4,00,000/-.

The applicant was arrested on 18/08/2015 and subjected
5042.15crapln -2to interrogation and presently in magisterial custody. Since other two accomplice of the present applicant are not traceable, learned trial Court rejected the application.

In my opinion, same cannot be a ground for detaining the present applicant in judicial custody as the investigation against the present applicant appears to be over, as is apparent from the investigation papers.

In view thereof, it will be appropriate, in my opinion, to order the release of the applicant on bail. Hence, I propose to pass the following order :- The applicant be released on bail, upon executing the P.R. bond of Rs.10,000/- (Rs. Ten thousand) with one surety in the like amount, in connection with Crime No. 109/2015 registered with Police Station, Renapur, District Latur for an offence punishable under Sections 364-A, 323, 504, 506 read with Section 34 of the Indian Penal Code. The applicant shall keep himself away from the jurisdiction of the concerned police station till filing of the charge sheet but for the investigation purpose.
