Mr.R.R. Kazi, learned advocate suo-moto appears for respondent no.2 and has filed affidavit in reply. The matter has been settled between the respondent-informant and the applicants. Record indicates that second appeal was pending before this Court and same has been disposed of in terms of compromise memo. A compromise decree has also been directed to be passed vide order dated 18.08.2023 passed by the learned Single Judge of this Court. 3.

The learned APP has strong reservations to allow the application. However, in view of the aforesaid factual back drop when the parties have gave up their disputes, we endorse the same and
